Terms and Conditions
These Terms and Conditions outline the agreement between Kerry’s Driving School ("the Instructor") and the Pupil ("the Student") for the provision of driving tuition. By booking and taking lessons, you agree to the following terms.
-
Standard lessons: Each lesson typically lasts for 2 hours (weekly lessons)
-
Intensive courses: 4 hours per day
1. Payment and Bookings
Weekly driving lessons
-
Payment is due in accordance with the payment arrangements agreed when lessons are booked.
-
At least 48 hours' notice is required to cancel or rearrange a weekly driving lessons.
-
Where less than 48 hours' notice is given, the full lesson fee may be payable unless the Instructor is able to fill the cancelled appointment with another pupil.
-
Exceptional circumstances will be considered individually.
Intensive courses
Reserving your dates
-
An intensive course requires a substantial block of teaching time to be removed from the Instructor's diary and reserved specifically for one pupil. A £200 booking deposit is therefore required to secure intensive course dates.
-
Until the deposit has been received and the Instructor has confirmed the booking in writing, proposed dates remain provisional and may be offered to another pupil.
-
The £200 deposit forms part of the total course price and is deducted from the final balance; it is not an additional charge.
Payment of the remaining balance
-
The remaining balance must be received no later than 10 working days before the first day of the course. If payment has not been received by this deadline, the Instructor reserves the right to release the dates to other pupils.
-
Payment arrangements must be completed before the intensive course begins unless the Instructor has expressly agreed otherwise in writing.
2. Cancellations and Rescheduling
If the Instructor needs to cancel a lesson (for example, due to illness, vehicle issues, or unsafe weather conditions), as much notice as possible will be given and an alternative date/time will be arranged.
Weekly driving lessons
You are required to give a minimum of 48 hours’ notice to cancel or reschedule a standard 2-hour lesson. Cancellations made with less than 48 hours’ notice will be charged in full.
Intensive courses
Please only reserve an intensive course when you are reasonably confident you can attend the agreed dates. If you cancel, the Instructor will make reasonable efforts to offer the cancelled teaching time to other pupils.
-
Where cancellation causes Kerry's Driving School a financial loss, the Instructor may retain from payments already made an amount reasonably reflecting that loss. This may include teaching time that was reserved for you and which the Instructor is unable to refill.
-
Any replacement income the Instructor obtains from rebooking the cancelled teaching time will be taken into account. You will not be charged twice for the same loss.
-
Where the loss is less than the amount already paid, the appropriate balance will be refunded.
The £200 booking deposit
-
The purpose of the booking deposit is to secure your dates and compensate for the commitment involved in withdrawing a substantial block of teaching time from availability.
-
If you cancel after the booking has been confirmed by the Instructor, the booking deposit may be retained to the extent reasonably necessary to cover losses arising from your cancellation.
-
If the Instructor cancels your course and you have not breached these terms, monies paid for teaching that has not been provided will be refunded.
Changes to course dates
-
Once an intensive course has been confirmed, the dates are reserved specifically for you. Requests to move a course to alternative dates will be considered where possible but are subject to availability and are not automatically guaranteed.
-
The original booking remains in place until the Instructor has confirmed alternative dates in writing.
-
If the Instructor cannot accommodate the requested change and you decide not to attend the original dates, this will normally be treated as a pupil cancellation and the cancellation provisions above will apply.
Saved or unused course hours
-
Where course hours are moved or retained by agreement rather than refunded, they must be used within three months of the original course dates, unless otherwise agreed in writing.
-
Unused hours remaining after this period may expire, subject to consumer law and the circumstances of the individual booking.
Work, holidays and personal circumstances
-
Please check work commitments, annual leave, childcare, travel and other foreseeable commitments before reserving an intensive course.
-
A change in your personal circumstances does not mean that Kerry's Driving School can absorb the financial cost of cancelling your reserved teaching time.
-
The Instructor appreciates that unexpected situations arise and will always try to minimise the financial impact by offering cancelled hours to other pupils. Any replacement income obtained will be taken into account when calculating the loss resulting from cancellation.
3. Pupil Requirements
Pupils must hold a valid UK provisional driving licence, be fit to drive (not under the influence of alcohol, drugs, or any medication that may impair driving ability), and be able to read a number plate from 20 metres (with glasses or contact lenses if normally worn).
The Instructor reserves the right to terminate a lesson if the pupil is unfit or unsafe to drive. The lesson fee will be forfeited in such cases.
Pupils must be ready to start the lesson on time. Your lesson start time is from the time you have booked. If the Instructor arrives at your mutually agreed pick-up place and you are not there, the Instructor will wait a maximum of 15 minutes before leaving. The lesson fee will be forfeited in such cases.
4. Lesson Conduct
The Instructor reserves the right to refuse or stop a lesson if the pupil behaves in a way that is unsafe, disrespectful, or causes risk to others or property. Pupils are expected to follow instructions and maintain a polite and professional attitude during lessons.
5. Vehicle and Insurance
The Instructor’s car is fully insured for driving tuition purposes. The Instructor will ensure the vehicle is roadworthy and maintained to a safe standard.
6. Driving Tests
-
Use of the instructor's vehicle for a practical driving test is subject to the instructor's professional assessment that the pupil can drive safely and independently to the required standard.
-
As part of the Instructor's test-readiness policy, pupils will normally be required to demonstrate test-ready driving in two mock driving tests before the Instructor's vehicle is made available for your practical test.
-
Booking an intensive course does not guarantee that a pupil will be ready to take a practical driving test by a particular date.
-
DVSA test fees are not included in lesson/course fees unless expressly stated otherwise.
7. Weather Cancellations
If lessons or tests are affected by severe weather conditions such as ice, snow or fog, the Instructor will assess whether it is safe to proceed. If cancelled for safety reasons, lessons will be rescheduled at no additional cost to the pupil. Pupils are encouraged to check with the Instructor on the morning of their lesson if conditions are poor.
8. GDPR and Data Protection Policy
Kerry’s Driving School collects and stores only essential personal data (such as name, contact details, and licence information) for lesson management and communication purposes. Data will not be shared with third parties except where required by law. All data is stored securely in accordance with GDPR. Pupils may request access to, correction, or deletion of their data at any time.
9. Limitation of Liability
Kerry’s Driving School will not be held responsible for any losses, injury, or damage caused by a pupil’s failure to comply with these Terms and Conditions.
While every effort is made to ensure progress, lesson outcomes and test passes cannot be guaranteed.
10. Acceptance of These Terms
-
Before paying a booking deposit or lesson fee, pupils should read these Terms & Conditions.
-
Payment of the booking deposit or lesson fee confirms acceptance of the booking and these Terms & Conditions, provided the terms have been made available to the pupil before payment.
-
Your statutory consumer rights are not affected.
11. Amendments
These Terms and Conditions may be updated from time to time. The latest version will always be available on the website.
